EXECUTIVE SUMMARY:

 

The San Diego Harbor Police Department (Harbor Police) identified the need for a new police/fire vessel given that the current fleet is beyond its serviceable life. In 2021, the Harbor Police was awarded a Port Security Grant (Grant) for $875,000 towards the purchase a new vessel, with the District being responsible for the rest of the cost. A Request for Proposal (RFP) was submitted resulting in a total of three vessel manufacturers submitting proposals. Following the interview process with the vessel manufacturers, MetalCraft Marine Inc. was selected based on the scoring criteria in the RFP. Staff recommends the Board select MetalCraft Marine Inc. and authorize a purchase agreement not to exceed $1,430,167.71 for the new vessel.

Recommendation

Adopt a resolution authorizing a purchase agreement not to exceed $1,430,167.71 with Metalcraft Marine Inc. for the purchase of a new Marine Firefighting Vessel for the Harbor Police Department utilizing $875,000 in Port Security Grant Program (PSGP) funding.

FISCAL IMPACT:

 

In November 2022, Harbor Police’s FY 2023 NPE Budget was increased by $1,213,334 for a new police/fire vessel with 75% funding from the FY21 PSGP grant and 25% District match to be funded from operations. The RFP total amount exceeded the $1,213,334 that was added to the budget by $216,833.71, for a new total of $1,430,167.71. Funds needed for this fiscal year are budgeted, and funds needed for FY2024 are in the proposed FY2024 Preliminary Budget.  Additional funds required for future fiscal years will be budgeted for in the appropriate fiscal years, subject to Board approval upon adoption of each fiscal year’s budget.

DISCUSSION:

 

The San Diego Harbor Police Department (Harbor Police) identified the need for a new police/fire vessel given that the current fleet is beyond its serviceable life. In 2010, Harbor Police started the purchase of five police/fire vessels from MetalCraft Marine. Although the service life initially noted by MetalCraft Marine was 15-20 years, the fleet deteriorated quicker than anticipated. Multiple causes can be attributed to this rapid deterioration. Maintenance, heavy usage, and diverse missions were deemed to be the main deterioration causes. In 2019, Harbor Police produced a document noting the needs and demands of a modern police/fire vessel fleet. With this information, a Vessel Planning Committee was formed in 2021 within the Harbor Police to discuss the operational needs of the Department. This Committee weighed the options of fixing the older fleet versus the purchase of new fleet. With the assistance of General Services mechanics, it was learned maintaining the current fleet would no longer be cost efficient. The search for a new vessel began with the Committee conducting research on current vessel platforms by reaching out to various police and fire agencies throughout the United States. Many of these agencies use the same or similar platforms. 

 

Based on the RFP requirements, criteria and proposals received through PlanetBids, District staff interviewed MetalCraft Marine, Inc., Moose Boat, and Metal Shark on April 5 and 6, 2023, and conducted a decision analysis based on the evaluation criteria in the RFP. The selection review panel identified MetalCraft Marine, Inc. as the top proposer because of the quality of products and competitive pricing. MetalCraft Marine, Inc. received the highest overall score, and staff believes their vessel best fits the needs of the Harbor Police’s diverse mission and the overall District needs. Staff recommends that the Board select MetalCraft Marine, Inc. and authorize the purchase of the vessel.

 

The Harbor Police is working with Procurement and MetalCraft Marine Inc. to finalize the specifications of the vessel with an expected delivery date of August 2024.

 

General Counsel’s Comments:

 

The Office of the General Counsel has reviewed and approved this agenda and resolution, as presented, as to form and legality, and will review and approve the resulting purchase agreement when final.

 

Environmental Review:

 

The proposed Board action, including without limitation, a resolution authorizing a purchase agreement not to exceed $1.43M with MetalCraft Marine Inc. for the purchase of a new marine firefighting vessel for the Harbor Police Department, in part,  utilizing Port Security Grant Program funding, does not constitute a project under the definition set forth in California Environmental Quality Act (CEQA) Guidelines Section 15378 because there is not a potential to result in a direct or indirect physical change in the environment. Therefore, the proposed Board action is not subject to CEQA and no further action under CEQA is required.

 

The proposed Board action complies with Sections 21 and 35 of the Port Act, which allow the Board to pass resolutions; and to do all acts necessary and convenient for the exercise of its powers. The Port Act was enacted by the California Legislature and is consistent with the Public Trust Doctrine. Consequently, the proposed Board action is consistent with the Public Trust Doctrine.

 

The proposed Board action does not allow for development, as defined in Section 30106 of the California Coastal Act, or new development, pursuant to Section 1.a. of the District’s Coastal Development Permit Regulations. Therefore, issuance of a Coastal Development Permit or an exclusion finding is not required.
