EXECUTIVE SUMMARY:

 

Board of Port Commissioners Policy No. 040 establishes a Commissioner Emeritus status for former Commissioners.  Commissioners who have held office for a period of at least 42 consecutive months since the formation of the San Diego Unified Port District (District) are eligible for appointment to Commissioner Emeritus status.  Garry Bonelli was appointed as a Commissioner January 3, 2014 through January 2, 2022.

 

RECOMMENDATION:

 

Recommendation

Adopt a Resolution authorizing proclamation and appointing Garry Bonelli as Commissioner Emeritus effective January 2, 2022.

DISCUSSION:

 

The Board of Port Commissioners recognizes the long and faithful service of certain citizens of this community who have given unselfishly of their time and energy in formulating the policies that have guided development of the District.  Garry Bonelli ably represented the City of Coronado as a Port Commissioner for the San Diego Unified Port District from January 3, 2014 through January 2, 2022, including service as Chairman in 2019. 

 

He gave generously of his time and energy to further the vision and goals of the District.  It is recommended that a Resolution authorizing a proclamation and appointing Garry Bonelli as Commissioner Emeritus be adopted.  A draft proclamation is included as Attachment A.

 

General Counsel’s Comments:

 

The General Counsel’s Office has reviewed the agenda sheet and attachments, as presented to it, and approves them as to form and legality.

 

Environmental Review:

 

The proposed Board action, including without limitation, a resolution authorizing an agreement to provide auditing services, does not constitute a “project” under the definition set forth in California Environmental Quality Act (CEQA) Guidelines Section 15378 because it will not have a potential to result in a direct or indirect physical change in the environment and is, therefore, not subject to CEQA. No further action under CEQA is required.

 

The proposed Board action complies with Section 35 of the Port Act, which allows the Board to do all acts necessary and convenient for the exercise of its powers. The Port Act was enacted by the California Legislature and is consistent with the Public Trust Doctrine. Consequently, the proposed Board action is consistent with the Public Trust Doctrine.

 

The proposed Board action does not allow for “development,” as defined in Section 30106 of the California Coastal Act, or “new development,” pursuant to Section 1.a. of the District’s Coastal Development Permit Regulations. Therefore, issuance of a Coastal Development Permit or exclusion is not required.
