IN THE AMOUNT OF $388,548.15 FOR THE ACQUISITION AND INSTALLATION OF A PERSISTENT CAMERA SYSTEM INSTALLED AT THE MARINE SAFETY CENTER, 950 OCEAN LANE, IMPERIAL BEACH, CA, AS AUTHORIZED BY THE BOARD IN AN AMENDED AGREEMENT WITH THE COUNTY OF SAN DIEGO AND AS PART OF THE LAW ENFORCEMENT HOMELAND SECURITY GRANT OPERATION STONEGARDEN FUNDS FOR FY2019.  FUNDS FOR THESE AGREEMENTS HAVE BEEN BUDGETED IN THE HARBOR POLICE DEPARTMENT’S FY2022 BUDGET.

EXECUTIVE SUMMARY:

 

Operation Stonegarden (OPSG) provides Federal grant funds allocated through the State to each County for the purpose of strengthening their abilities to detect, respond to, and defend against acts of violence from terrorist and transnational organized crime. This process allows each County to identify local priorities and fund those projects which support establishing, developing, and maintaining these regional capabilities.

 

This project provides a continuous, full-resolution surveillance camera system to monitor the coastal waters west of the Imperial Beach Pier. This system combines wide area fields of view, high-resolution video and advanced motion detection to provide situational awareness for Homeland Security missions and other incidents that require persistent visual domain awareness of wide areas.

 

The purchase and installation of this system will further the Harbor Police Department’s mission to detect, interdict and deter criminal activities within the District’s jurisdiction including contraband/human trafficking and prevent possible terrorist incidents.

 

On September 27, 2021, the Port of San Diego issued a Request for Bids (RFB) 21-26MA, which allowed for bidding up to October 18, 2021. In all, 1396 bidders were notified of this RFB, with 83 vendors signing up as prospective bidders. 3 bids were received; the lowest bidder was found to be non-responsive due to not meeting specifications, making Innovative Signal Analysis, Inc. the lowest responsive bidder.

 

RECOMMENDATION:

 

Recommendation

Adopt a resolution authorizing a Purchase and Installation Agreements with Innovative Signal Analysis, Inc. in the amount of $388,548.15 for the acquisition and installation of a surveillance camera system to be installed at the Imperial Beach Marine Safety Center, 950 Ocean Lane, as authorized by the Board in an Amended Agreement with the County of San Diego and as part of the Federal Department of Homeland Security “Operation Stonegarden” grant funds for FY2019. Funds for these agreements have been budgeted in the Harbor Police Department’s FY2022 budget.

FISCAL IMPACT:

 

The District was awarded $350,000 in funding from the FY2019 Department of Homeland Security “Operation Stonegarden” grant and there is no District cash match required. The grant performance period for this grant ends May 31, 2022. This funding is currently budgeted in the Harbor Police Department’s FY2022 budget.  Since this camera system will be integrated into the District’s existing “Port-wide” system there are anticipated to be no additional recurring operational costs. All short-term maintenance costs will be included as part of the service agreement with the selected vendor.

DISCUSSION:

 

Operation Stonegarden is a federally funded grant program to provide additional law enforcement operations to deter, detect, interdict and criminal activity in the United States along the international borders of Mexico and Canada. This grant funded program was first implemented in San Diego and, through its Maritime mission, the Harbor Police Department has supported the program.  The Maritime Domain Awareness mandate for the District remains unchanged and focused on protecting the District from threats of violence from terrorism and transnational criminal elements. 

 

As a continued effort to meet this security requirement, the district has developed a comprehensive structure of sensors intended to detect, deter and respond to these threats.  This project, which provides a continuous, full-resolution surveillance camera system to monitor the coastal waters west of the Imperial Beach Pier, fulfills an identified gap in the Districts current capabilities.  Combining a wide area field of view, high-resolution video, advanced motion detection, persistent visual domain awareness and the capability of track multiple targets simultaneously, Harbor Police Department achieves our requirement for situational awareness for Homeland Security. 

 

This surveillance technology has successfully been implemented at other locations within the District’ surveillance camera network.  The Watch Stander at the Joint Harbor Operations Center (JHOC) monitors this system. All Law Enforcement partners represented at the JHOC will have access to the surveillance data in support of the “Operation Stonegarden” mission objectives. The purchase and installation of this system will further the Harbor Police Department’s mission.

 

General Counsel’s Comments:

 

The Office of the General Counsel has reviewed and approved this agenda, proposed agreements, and resolution, as presented, as to form and legality.

 

Environmental Review:

 

The proposed Board action, including without limitation, a resolution authorizing a purchase and installation agreements for the installation of camera equipment on an existing public building, is Categorically Exempt pursuant to California Environmental Quality Act (CEQA) Guidelines Sections 15301 Existing Facilities, and Section 3.a of the District’s Guidelines for Compliance with CEQA because the project would consist of installation of camera equipment on an existing public building that would involve no expansion of use beyond that previously existing. The District has determined none of the six exceptions to the use of a categorical exemption apply to this project (CEQA Guidelines Section 15300.2). No further action under CEQA is required.

 

The proposed Board action complies with Sections 21, 35, and 87 of the Port Act, which allow the Board to pass resolutions and to do all acts necessary and convenient for the exercise of its powers, and which authorizes the use of tidelands for all commercial and industrial uses and purposes, and the construction, reconstruction, repair, and maintenance of commercial and industrial buildings, plants, and facilities. The Port Act was enacted by the California Legislature and is consistent with the Public Trust Doctrine. Consequently, the proposed Board action is consistent with the Public Trust Doctrine.

 

The proposed Board action is considered “excluded development” pursuant to Sections 8.a. (Existing Facilities) of the District’s Coastal Development Permit Regulations because the project would consist of installation of camera equipment on an existing public building that would involve no expansion of use beyond that previously existing. No further action under the Coastal Act is required.
