EXECUTIVE SUMMARY:
Law enforcement officers are the guardians of life and property, defenders of the individual right to be free, and warriors in the battle against crime. These dedicated women and men who have chosen law enforcement as a career face extraordinary risk and danger in preserving our freedom and security.
In May of each year National Police Week is observed throughout the nation in order to recognize the hazardous work, serious responsibilities and strong commitment to our nation’s peace officers. In conjunction with National Police Week, this year, May 6th is recognized as San Diego Law Enforcement Officers’ Memorial Day in commemoration of those officers who have sacrificed their lives in the line of duty. These special observances provide an opportunity for the community to acknowledge the heroic women and men who have dedicated their lives to safeguarding public safety and to honor the men and women who have given their lives while fulfilling this commitment to the citizens of San Diego County.

DISCUSSION:
Established in 1962 by President John F. Kennedy and a joint resolution of Congress, National Police Week pays special tribute to those law enforcement officers who lost their lives in the line of duty for the safety and protection of others. Ceremonies are held in Washington, D.C. and in communities across the country. This year, however, due to the global pandemic, memorial ceremonies in San Diego County and throughout the state of California have been cancelled. This year it is especially important to remember and commemorate those officers who have sacrificed their lives in the line of duty for the citizens of San Diego County.
General Counsel’s Comments:
The General Counsel’s office reviewed this Agenda and proposed resolution as presented to it for form and legality and approves same.
Environmental Review:
The proposed Board action does not constitute a “project” under the definition set forth in California Environmental Quality Act (CEQA) Guidelines Section 15378 because it would not have the potential to result in a direct or indirect physical change in the environment and is, therefore, not subject to CEQA. No further action under CEQA is required.
The proposed Board action complies with sections 21 and 35 of the Port Act, which allow the Board to pass resolutions and to do all acts necessary and convenient for the exercise of its powers. The Port Act was enacted by the California Legislature and is consistent with the Public Trust Doctrine. Consequently, the proposed Board action is consistent with the Public Trust Doctrine.
The proposed Board action does not allow for “development,” as defined in Section 30106 of the California Coastal Act, or “new development,” pursuant to Section 1.a. of the District’s Coastal Development Permit Regulations. Therefore, issuance of a Coastal Development Permit or exclusion is not required.
