EXECUTIVE SUMMARY:

 

Since 1960, American Public Works Association (APWA) has sponsored National Public Works Week (NPWW).  NPWW is a celebration of the tens of thousands of men and women in North America who work in professions that provide and maintain public facilities and services collectively known as public works. Across the nation, NPWW calls attention to the importance of public works in community life. This year NPWW will be celebrated May 17-23, 2020.  The week seeks to increase public awareness of their contributions as well as to enlighten the public about the duties, practices, and goals of public works professionals.

Adopt a Resolution proclaiming May 17-23, 2020 National Public Works Week at the Port of San Diego

DISCUSSION:

 

Since 1960, American Public Works Association (APWA) has sponsored National Public Works Week (NPWW).  NPWW is a celebration of the tens of thousands of men and women in North America who work in professions that provide and maintain public facilities and services collectively known as public works. Across the nation, NPWW challenges everyone to think about their communities as a symphony of essential services, working in concert to create a great place to live.

 

The San Diego Unified Port District wishes to show its support for the APWA. The APWA has selected "The Rhythm of Public Works" as its theme for 2020's NPWW, which will be celebrated May 17-23, 2020 (See Attachment A). According to the APWA:

 

“Public Works keeps a community’s rhythm moving by providing an orchestra of infrastructure services in transportation, water, wastewater, and stormwater treatment, public buildings and spaces, parks, and grounds, emergency management and first response, solid waste, and right-of-way management. Public Works provides the harmony needed for collaboration with all the stakeholders in capital projects, infrastructure solutions, and quality of life services.” See https://npww.apwa.net/

 

Staff recommends the Board adopt the resolution in support of National Public Works Week.

 

General Counsel’s Comments:

 

The General Counsel’s Office has reviewed the agenda sheet and attachments, as presented to it, and approves them as to form and legality.

 

Environmental Review:

 

The proposed Board action, including without limitation, a resolution proclaiming support of National Public Works Week, does not constitute a “project” under the definition set forth in California Environmental Quality Act (CEQA) Guidelines Section 15378 because it will not have a potential to result in a direct or indirect physical change in the environment and is, therefore, not subject to CEQA. No further action under CEQA is required.

 

The proposed Board action complies with Sections 21 and 35 of the Port Act, which allow the Board to pass resolutions and to do all acts necessary and convenient for the exercise of its powers. The Port Act was enacted by the California Legislature and is consistent with the Public Trust Doctrine. Consequently, the proposed Board action is consistent with the Public Trust Doctrine.

 

The proposed Board action does not allow for “development,” as defined in Section 30106 of the California Coastal Act, or “new development,” pursuant to Section 1.a. of the District’s Coastal Development Permit Regulations. Therefore, issuance of a Coastal Development Permit or exclusion is not required.
