EXECUTIVE SUMMARY:

 

Since 1960, American Public Works Association (APWA) has sponsored National Public Works Week (NPWW).  NPWW is a celebration of the tens of thousands of men and women in North America who work in professions that provide and maintain public facilities and services collectively known as public works. Across the nation, NPWW calls attention to the importance of public works in community life. This year NPWW will be celebrated May 19 - 25, 2019.  The week seeks to increase public awareness of their contributions as well as to enlighten the public about the duties, practices, and goals of public works professionals.

Adopt a Resolution proclaiming May 19-25, 2019 National public Works Week at the Port of San Diego

DISCUSSION:

 

Since 1960, American Public Works Association (APWA) has sponsored National Public Works Week (NPWW).  NPWW is a celebration of the tens of thousands of men and women in North America who work in professions that provide and maintain public facilities and services collectively known as public works. Across the nation, NPWW calls attention to the importance of public works in community life. The week seeks to increase public awareness of their contributions as well as to enlighten the public about the duties, practices, and goals of public works professionals.

 

Public works professionals focus on infrastructure, facilities and services that are of vital importance to sustainable and resilient communities and to the public health, high quality of life and well-being of the people.  These infrastructure, facilities and services could not be provided without the dedicated efforts of public works professionals, who are engineers, managers and employees at all levels of government and the private sector, who are responsible for rebuilding, improving and protecting our nation’s transportation, water supply, water treatment and solid waste systems, public buildings, and other structures and facilities essential for our citizens.

 

The San Diego Unified Port District wishes to show its support for the APWA. APWA has selected "It Starts Here" as its theme for 2019's NPWW, which will be celebrated May 19 - 25, 2019. Public works projects and services improve quality of life and social benefits, and they are one of the basic elements of our civilized society and our nation's economic growth.

 

General Counsel’s Comments:

 

The Office of the General Counsel has reviewed and approved this agenda as to form and legality.

 

Environmental Review:

 

The proposed Board direction or action, including without limitation, a resolution proclaiming support of National Public Works Week, does not constitute a “project” under the definition set forth in California Environmental Quality Act (CEQA) Guidelines Section 15378 because it will not have a potential to result in a direct or indirect physical change in the environment and is, therefore, not subject to CEQA. No further action under CEQA is required.

 

In addition, the proposed Board direction or action complies with Sections 21 and 35 of the Port Act, which allow the Board to pass resolutions and to do all acts necessary and convenient for the exercise of its powers. The Port Act was enacted by the California Legislature and is consistent with the Public Trust Doctrine. Consequently, the proposed Board action is consistent with the Public Trust Doctrine.

 

Finally, the proposed Board direction or action does not allow for “development,” as defined in Section 30106 of the California Coastal Act, or “new development,” pursuant to Section 1.a. of the District’s Coastal Development Permit Regulations. Therefore, issuance of a Coastal Development Permit or exclusion is not required.
