EXECUTIVE SUMMARY:

 

This action will authorize as-needed agreements for professional services to provide specialty security services that augment and expand current security services for military related cargo operations at the Tenth Avenue Marine Terminal.

 

The District’s current agreement with Allied Universal Security Services (AUS) provides full-time security guards for the Tenth Avenue Marine Terminal (TAMT) and the Joint Harbor Operations Center (JHOC), as well as part-time security during cruise ship operations at both Broadway and B Street Cruise ship Terminals.  AUS has limited capabilities beyond its current, contracted security commitments, which has resulted in sub-optimal security services provided during military operations at TAMT.

 

Improvement of the District’s ability to meet the military’s specialized requirements, with as-needed specialty security service providers who can field a cadre’ of armed and unarmed security specialists with limited notice, and the inclusion of a requirement to provide boats and boat operators enhances the District’s ability to support the mission as a strategic port and could potentially increase the suitability of the District for increased military support operations.

 

Overall security funds for the District have already been included in the FY 2019 Budget, therefore this action does not increase the FY 2019 Budget.  Funds required for future fiscal years will be budgeted in the appropriate fiscal year, subject to Board approval upon adoption of each fiscal year’s budget

 

Each agreement is for a five-year period.  The aggregate total of all agreements will not exceed $500,000.

 

Pursuant to BPC Policy No. 110, the District issued RFP 19-02SN on February 13, 2019. The District received 3 responsive proposals. Based on the written proposal and a decision analysis process using the criteria stated in the RFP, the service providers determined to be the highest quality for the services solicited are Six Maritime and Security Services Northwest, Inc. Upon board approval, agreements with the recommended firms, as attached will be executed.

Recommendation

Adopt a Resolution selecting and authorizing agreements with Six Maritime and Security Services Northwest, Inc for as-needed specialty security services for a total aggregate amount not to exceed $500,000.

FISCAL IMPACT:

 

Funds for FY2019 are budgeted.  Funds required for future fiscal years will be budgeted for in the appropriate year subject to Board approval upon adoption of each fiscal year’s budget.

 

The majority of security services would be passed through to the requestor of services and are additionally subject to a 15% management fee in the Port Tariff.

DISCUSSION:

 

The increase in military operations at Tenth Avenue Marine Terminal (TAMT) over the last several years has exceeded the manpower and capabilities of the current service provider’s contractual obligations and has required outsourcing security to the operational disadvantage of the District.  Short-notice security requests to support military surge operations limit the District’s ability to meet these requests with a talented and professional pool of maritime security professionals.

 

The District’s current agreement with Allied Universal Security Services (AUS) provides full-time security guards for the Tenth Avenue Marine Terminal (TAMT) and the Joint Harbor Operations Center (JHOC), as well as part-time security during cruise ship operations at both Broadway and B Street Cruise ship Terminals.  AUS has limited capabilities beyond its current, contracted security commitments. While the AUS budget is enough for the duration of the contract, the increased demand for additional security services throughout the District continue to tax the manpower, budget, and mission of the base contract.

 

Improvement of the District’s ability to meet the military’s specialized security requirements with as-needed specialty security service providers who can field a cadre’ of armed and unarmed security specialists with limited notice, and the inclusion of a requirement to provide boats and boat operators enhances the District’s ability to support the mission as a strategic port and could potentially increase the suitability of the District for increased military support operations.

 

Staff has implemented the process for procurement of service providers in accordance with BPC Policy No. 110. The RFP for As-Needed Specialty Security Services was issued on February 13, 2019. During the advertisement period, 465 vendors were notified, 37 vendors downloaded the RFP, and three responsive proposals were received.

 

Three proposals were reviewed and ranked by a cross-departmental panel of District staff, based upon the criteria established in the RFP. The selection panel found that Six Maritime and Security Services Northwest, Inc. were the highest quality based upon their relevant experience, capability to perform, approach to the project, and reasonable cost. Based on the analysis, staff concluded the proposed agreements will achieve the best results for the District.  Staff recommends the Board adopt a resolution selecting and authorizing agreements with Six Maritime and Security Services Northwest, Inc. for As-Needed Specialty Security Services.

 

General Counsel’s Comments:

 

The Office of the General Counsel has reviewed and approved the proposed agreements as to form and legality.

 

Environmental Review:

 

The proposed Board action, including without limitation, a resolution selecting and authorizing agreements for as-needed security services for military related cargo operations, does not constitute an “approval” or a “project” under the definitions set forth in California Environmental Quality Act (CEQA) Guidelines Sections 15352 and 15378 because no direct or indirect changes to the physical environment would occur. CEQA requires that the District adequately assess the environmental impacts of projects and reasonably foreseeable activities that may result from projects prior to the approval of the same.  Any project developed as a result of Board’s action that requires the District or the Board’s discretionary approval resulting in a physical change to the environment will be analyzed in accordance with CEQA prior to such approval.  CEQA review may result in the District, in its sole and absolute discretion, requiring implementation of mitigation measures, adopting an alternative, including without limitation, a “no project alternative” or adopting a Statement of Overriding Consideration, if required. The current Board direction in no way limits the exercise of this discretion. Therefore, no further CEQA review is required.

 

In addition, the proposed Board direction or action complies with sections 21, 35, 81, and 87 of the Port Act, which allow for the Board to pass resolutions, to do all acts necessary and convenient for the exercise of its powers, to use District funds for expenses of conducting the District, and for the use of tidelands for the establishment, improvement, and conduct of a harbor. The Port Act was enacted by the California Legislature and is consistent with the Public Trust Doctrine. Consequently, the proposed Board action is consistent with the Public Trust Doctrine.

 

The proposed Board action does not allow for “development,” as defined in Section 30106 of the California Coastal Act, or “new development,” pursuant to Section 1.a. of the District’s Coastal Development Permit (CDP) Regulations because they will not result in, without limitation, a physical change, change in use or increase the intensity of uses. Therefore, issuance of a Coastal Development Permit or exclusion is not required. However, development within the District requires processing under the District’s CDP Regulations. Future development, as defined in Section 30106 of the Coastal Act, will remain subject to its own independent review pursuant to the District’s certified CDP Regulations, PMP, and Chapters 3 and 8 of the Coastal Act.  The Board’s direction or action in no way limits the exercise of the District’s discretion under the District’s CDP Regulations. Therefore, issuance of a CDP or exclusion is not required at this time.
