EXECUTIVE SUMMARY:

 

The San Diego Unified Port District (District) contracts for as-needed pressure washing services to help maintain a clean, healthy, and vibrant waterfront destination where residents and visitors converge. Services include cleaning of buildings, patios, sidewalks, parking lots, benches, concrete tables, piers, docks, trash enclosures, playground equipment, and sprung structures. The current agreement with Aztec Landscaping, Inc. will expire on June 30, 2019.

 

Pursuant to the Board of Port Commissioners Policy (BPC) No. 110, Section II, C, a Request for Bid (RFB) No. 18-MA was solicited on June 19, 2018 and closed on August 16, 2018. A total of six hundred twenty (620) potential service providers were notified; the District received three (3) responsive and two (2) nonresponsive bids. Staff recommends the Board select and authorize an agreement with Aztec Landscaping, Inc. to provide as-needed pressure washing services effective July 1, 2019 through June 30, 2024, in an amount not-to-exceed $441,000.

Recommendation

Adopt a resolution selecting and authorizing an agreement with Aztec Landscaping, Inc. for as-needed pressure washing services effective July 1, 2019 through June 30, 2024, in amount not-to-exceed $441,000.

FISCAL IMPACT:

 

Funds for the first year of this expenditure are included in the FY2019 General Services Department facilities maintenance expense budget. All funds required for future fiscal years will be budgeted in the appropriate fiscal year, subject to Board approval upon adoption of each fiscal year’s budget.

DISCUSSION:

 

The San Diego Unified Port District (District) contracts for as-needed pressure washing services for the Port properties within the cities of San Diego, Coronado, National City, Chula Vista and Imperial Beach. Services include the cleaning of buildings, patios, sidewalks, parking lots, benches, concrete tables, piers, docks, trash enclosures, playground equipment, and sprung structures. The current As-Needed Pressure Washing Services Agreement between the District and Aztec Landscaping, Inc. expires on June 30, 2019.

 

The Board approved the current agreement on April 8, 2015, Clerk Doc. No. 63318, in amount not-to-exceed $86,161.81.  Amendment No. 1 to the agreement was approved by the Board on October 18, 2017, Clerk Doc. No. 67406, in response to the District’s Hepatitis A prevention efforts in an amount not-to-exceed $175,000. The Board approved Amendment No. 2 on December 13, 2017, Clerk Doc. No. 67579, to increase the total amount of the agreement to $1,319,208.14 to continue the prevention efforts in curtailing the Hepatitis A outbreak.

 

As required by BPC 110, Request for Bid (RFB) No. 18-MA was solicited through Planet Bids on June 19, 2018, and closed on August 16, 2018. A total of six hundred twenty (620) potential service providers were notified, and only five (5) bid responses were received by the District.

 

The five (5) bids were evaluated, and it was determined that only three (3) were responsive. The remaining two (2) were deemed non-responsive for not having a valid California Contractors License, Class C61/D38 for Sand and Water Blasting, as required in RFB sec. III. F. b.

 

The three (3) responsive bids were accepted and are summarized below from the lowest to the highest:

 

                     Aztec Landscaping, Inc.                                          $356,352.46

                     

                     Triton Power Washing                                           $717,000.00

 

                     Pure Cleaning                                                               $840,002.00

 

Staff is requesting that the Board approve an agreement with Aztec Landscaping, Inc. for as-needed power washing services in an amount not-to-exceeded $441,000. This amount includes $356,352.46 for the power washing services agreement, and $84,647.54 for any additional power washing services not included in the agreement.

 

Staff recommends the Board select and authorize an agreement with Aztec Landscaping, Inc. to provide as-needed pressure washing services effective July 1, 2019 through June 30, 2024, in an amount not-to-exceed $441,000.

 

General Counsel’s Comments:

 

The Office of the General Counsel has reviewed the issues set forth in this and found no legal concerns as presented, and has reviewed and approved the agreement as to form and legality.

 

Environmental Review:

 

The proposed Board direction or action, including without limitation, a resolution authorizing an agreement with Aztec Landscaping, Inc. for as-needed pressure washing services is Categorically Exempt pursuant to California Environmental Quality Act (CEQA) Guidelines Sections 15301 (Existing Facilities) and Section 3.a. of the District’s Guidelines for Compliance with CEQA because the project in question would no expansion of use beyond that previously existing. The District has determined none of the six exceptions to the use of a categorical exemption apply to this project (CEQA Guidelines Section 15300.2). No further action under CEQA is required.

 

The proposed Board direction or action complies with Section 87 of the Port Act, which allows for the construction, reconstruction, repair, maintenance, and operation of public buildings, public assembly and meeting places, convention centers, parks, playgrounds, bathhouses and bathing facilities, recreation and fishing piers, public recreation facilities, including, but not limited to, public golf courses, and for all works, buildings, facilities, utilities, structures, and appliances incidental, necessary, or convenient for the promotion and accommodation of any of those uses. The Port Act was enacted by the California Legislature and is consistent with the Public Trust Doctrine. Consequently, the proposed Board direction or action is consistent with the Public Trust Doctrine.

 

Finally, the proposed Board direction or action is considered “excluded development” pursuant to Section 8.a. (Existing Facilities) of the District’s Coastal Development Permit Regulations because the project in question would involve no expansion of use beyond that previously existing. Issuance of a Coastal Development Permit is not required for the proposed Board direction or action.
