EXECUTIVE SUMMARY:

 

Under San Diego Unified Port District (District or Port) Board of Port Commissioners (BPC or Board) Policy No. 018-Board Advisory Committees, each of the advisory committees shall develop a general work plan with goals for the calendar year. On March 21, 2018, the Accessibility Advisory Committee approved a work plan for calendar year 2018, which is presented to the Board for consideration and approval.

Adopt a Resolution approving Calendar Year 2018 Work Plan for the Accessibility Advisory Committee Pursuant to Board of Port Commissioners Policy No. 018-Board Advisory Committees.

DISCUSSION:

 

The Accessibility Advisory Committee is an eight-member committee representing a broad spectrum of disabilities including mental and physical disabilities as defined by the Americans with Disabilities Act (ADA). Its overall mission is to educate, advise and assist the Board in ensuring that all services, programs and facilities on Port Tidelands are fully usable and accessible to all. The Accessibility Advisory Committee’s vision is Universal Design, which is the design of products and environments to be usable by all to the greatest extent possible, without the need for adaptation or specialized design.

 

In accordance with BPC Policy No. 018, the Accessibility Advisory Committee reviewed and approved its work plan for 2018 at its meeting on March 21, 2018. In support of the District’s Strategic Goals, the Accessibility Advisory Committee’s work plan focuses on three general categories, including outreach and education, ADA enhancement projects, and Universal Design efforts, and is fully set forth in Attachment A. Focusing on these categories will continue fostering positive connection to the community and accessibility for all on Tidelands. Accessibility Advisory Committee members discussed the work plan and recommended the plan be submitted to the Board for approval.

 

General Counsel’s Comments:

 

The Office of the General Counsel has reviewed the issues presented in this agenda sheet and approves as to form and legality.

 

Environmental Review:

 

The proposed Board direction or action, including without limitation, approving the 2018 Work Plan for the Accessibility Advisory Committee Pursuant to BPC Policy No. 018- Board Advisory Committees, does not constitute a “project” under the definition set forth in California Environmental Quality Act (CEQA) Guidelines Section 15378 because it will not have a potential to result in a direct or indirect physical change in the environment and is, therefore, not subject to CEQA. No further action under CEQA is required.

 

In addition, the proposed Board action complies with Sections 21, 30, and 35 of the Port Act which allow necessary and convenient acts. The Port Act was enacted by the California Legislature and is consistent with the Public Trust Doctrine. Consequently, the proposed Board action is consistent with the Public Trust Doctrine.

 

Finally, the proposed Board action does not allow for “development,” as defined in Section 30106 of the California Coastal Act, or “new development,” pursuant to Section 1.a. of the District’s Coastal Development Permit Regulations. Therefore, issuance of a Coastal Development Permit or exclusion is not required.
