IN THE AMOUNT OF $218,000 FOR THE REPAINTING OF PASSENGER BOARDING FACILITIES AT B STREET PIER CRUISE SHIP TERMINAL, AS AUTHORIZED BY THE BOARD IN THE FY17/18 MAJOR MAINTENANCE BUDGET PROGRAM

EXECUTIVE SUMMARY:

This action will adopt and approve plans and specifications and authorize the award of a major maintenance construction contract to TL Veterans Construction Inc. in the amount of $218,000 for the Repainting of Passenger Boarding Facilities at B Street Pier Cruise Ship Terminal (Project).

The plans and specifications define the contract work as including the preparation and repainting of the painted areas of the existing fixed passenger access balcony and the designated areas of the existing mobile passenger gangway.

On December 6th, 2017, seven (7) bids were received ranging from $218,000 to $392,000. The lowest responsive and responsible bid was submitted by TL Veterans Construction Inc. in the amount of $218,000. Award to this bidder is recommended.

Recommendation

Adopt a resolution approving plans and specifications and awarding Contract No. 2017-53 to TL Veterans Construction Inc. in the amount of $218,000 for the Repainting of Passenger Boarding Facilities at B Street Pier Cruise Ship Terminal as authorized, by the Board in the FY 17/18 Major Maintenance program.

FISCAL IMPACT:

This Project is included in the FY 17/18 Major Maintenance Expense Program budget for $450,000 to complete construction.

Approval of this agenda will authorize the expenditure of $218,000 from the FY 17/18 Ordinary Annual Expense budget funding appropriation.

Award of this construction contract will implement the Major Maintenance Program, approved by the Board to be in alignment with the District’s vision, mission and strategic goals.

This agenda item supports the following Strategic Goal(s).

                     A vibrant waterfront destination where residents and visitors converge.

                     A Port with a healthy and sustainable bay and its environment.

DISCUSSION:

The original project name was the Mobile Gangway Repairs at Cruise Ship Terminal, budgeted at $450,000 in the FY 17/18 Major Maintenance Program.  After the initial engineering evaluation and coordination with the District’s Maritime and General Services Departments, it was determined that the extent of the repairs necessary to restore the mobile gangway to an acceptable condition was to clean and prepare the rusted areas for paint.  The Project also includes repainting of the existing passenger access balcony.  Therefore the name of the Project was changed to the current name, Repainting of Passenger Boarding Facilities at B Street Pier Cruise Ship Terminal.

The existing passenger boarding facilities consisting of the fixed passenger access balcony and the mobile passenger gangway are situated at the north side of the B Street Pier Cruise Ship Terminal.  Both facilities were installed in 2002 and need to be repainted and refurbished to restore them to their original condition.

The work includes the following:

1). Overall preparation and repainting of the existing painted areas of the fixed passenger access balcony including cleaning of corroded areas, washing the surface of the entire exterior structure, and applying the painting system to the prepared interior and exterior structure surfaces;

2). Preparation and repainting of designated areas of the existing mobile passenger gangway including cleaning of corroded supporting areas, and applying the painting system to the prepared areas.

 

 

The Contract Documents including plans (No. EM-2017-05) and specifications (No. 2017-53) that were issued on the District PlanetBids on November 7, 2017.  On December 7, 2017, seven (7) bids were received ranging from $218,000 to $392,000.  The bid amounts are as shown in the table below:

 

The lowest responsive and responsible bid was submitted by TL Veterans Construction Inc. in the total bid amount of $218,000.  The engineer’s construction cost estimate was $281,000.

Upon Board authorization, construction is expected to commence in February 2018 and will be completed by May 2018.

Staff recommends that the Board approve the plans and specifications and award Contract No. 2017-53 to TL Veterans Construction Inc. in the amount of $218,000 for the construction of the Repainting of Passenger Boarding Facilities at B Street Pier Cruise Ship Terminal project.

 

General Counsel’s Comments:

 

The Office of the General Counsel has reviewed the bid documents and approves as to form and legality.

 

Environmental Review:

 

The proposed Board action to approve plans and specifications and award a contract to TL Veterans Construction for the repainting of passenger boarding facilities at B Street Pier Cruise Ship Terminal is Categorically Exempt pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15301 (Class 1 - Existing Facilities) and Section 3.a. (1) of the District’s Guidelines for Compliance with CEQA because the project in question will involve no expansion of use beyond that previously existing. The District has determined none of the six exceptions to the use of a categorical exemption apply to this project (CEQA Guidelines Section 15300.2). No further action under CEQA is required.

 

The proposed Board action complies with Section 87 of the Port Act, which allows for the establishment, improvement, and conduct of a harbor, and for the construction, reconstruction, repair, maintenance, and operation of wharves, docks, piers, slips, quays, and all other works, buildings, facilities, utilities, structures, and appliances incidental, necessary or convenient, for the promotion and accommodation of commerce and navigation. The Port Act was enacted by the California Legislature and is consistent with the Public Trust Doctrine. Consequently, the proposed Board action is consistent with the Public Trust Doctrine.

 

In addition, the proposed Board action is considered “excluded development” pursuant to Section 8.a. (Existing Facilities) of the District’s Coastal Development Permit Regulations; therefore, issuance of a Coastal Development Permit is not required.
