EXECUTIVE SUMMARY:

 

Board of Port Commissioners Policy No. 040 establishes a Commissioner Emeritus status for former Commissioners.  Commissioners who have held office for a period of at least 42 consecutive months since the formation of the San Diego Unified Port District (District) are eligible for appointment to Commissioner Emeritus status.  Bob Nelson served as a Commissioner from January 2011 through May 16, 2017.

 

RECOMMENDATION:

 

Recommendation

Adopt a Resolution authorizing proclamation and appointing Bob Nelson as Commissioner Emeritus effective June 20, 2017.

DISCUSSION:

 

The Board of Port Commissioners recognizes the long and faithful service of certain citizens of this community who have given unselfishly of their time and energy in formulating the policies that have guided development of the District.  Bob Nelson ably represented the City of San Diego as a Port Commissioner for the San Diego Unified Port District from January 2011 through May 16, 2017, including service as Chairman in 2014. 

 

Prior to his service to the District, he was long active in civic affairs serving as the Chairman of the San Diego Convention Center Corporation, San Diego LGBT Community Center, and City of San Diego Revenue Review and Economic Competitiveness Commission.  Also, President Bill Clinton named him to the U.S. Competitiveness Policy Council.

During his tenure as a Commissioner, Bob Nelson served with a dedication to the environment and the Port’s surrounding communities.  He was one of the key contributors to the Climate Action Plan, which was adopted by the Board in 2013 to reduce greenhouse gas emissions on Port tidelands, and reduce the Port’s environmental impact for years to come by managing energy and water use. 

 

He gave generously of his time and energy to further the vision and goals of the District.  As Chairman of the Board in 2014, he adopted the theme “Building our Future Together, Adellante!” for the Port of San Diego.  As a Commissioner, Bob Nelson embodied the spirit of the word, “Adellante!” which means “Forward!” in Spanish.  It is recommended that a Resolution authorizing a proclamation and appointing Bob Nelson as Commissioner Emeritus be adopted.  A draft proclamation is included as Attachment A.

 

General Counsel’s Comments:

 

The General Counsel’s Office has reviewed the issues set forth in this agenda sheet, and there are no legal concerns as presented.

 

Environmental Review:

 

The proposed Board action does not constitute a “project” under the definition set forth in California Environmental Quality Act (CEQA) Guidelines Section 15378 because it will not have a potential to result in a direct or indirect physical change in the environment and is, therefore, not subject to CEQA.  No further action under CEQA is required.

 

In addition, the proposed Board action allows for the District to implement its obligations under the Port Act and/or other laws. The Port Act was enacted by the California Legislature and is consistent with the Public Trust Doctrine. Consequently, the proposed Board action is consistent with the Public Trust Doctrine.

 

Finally, the proposed Board action does not allow for “development,” as defined in Section 30106 of the California Coastal Act, or “new development,” pursuant to Section 1.a. of the District’s Coastal Development Permit Regulations.  Therefore, issuance of a Coastal Development Permit or exclusion is not required.
