RESOLUTION ADOPTING AND APPROVING PLANS AND SPECIFICATIONS AND AWARDING CONTRACT NO. 2016-25 TO ABHE & SVOBODA, INC.  IN THE AMOUNT OF $571,321 FOR THE STRUCTURAL REPAIRS TO BROADWAY PIER PROJECT, AS AUTHORIZED BY THE BOARD IN THE FY 16/17 MAJOR MAINTENANCE BUDGET PROGRAM

EXECUTIVE SUMMARY:

 

This action will adopt and approve plans and specifications and authorize the award of a major maintenance construction contract for repairs of the existing deteriorated structural components of the Broadway Pier.

 

The plans and specifications define the contract work including repairing piles/concrete encasements, pile cap areas, structural beam areas, and deck soffit locations of the pier.  This repair will prevent further deterioration and will maintain the pier facility in good condition.

On May 16th, 2017, four (4) bids were received ranging from $571,321 to $1,280,890. The lowest responsive and responsible bid was submitted by Abhe & Svoboda, Inc. in the amount of $571,321. Award to this bidder is recommended.

Recommendation

Adopt a resolution approving plans and specifications and awarding Contract No. 2016-25 to Abhe & Svoboda, Inc. in the amount of $571,321 for the Structural Repairs to Broadway Pier project, as authorized by the Board in the FY 16/17 Major Maintenance program.

FISCAL IMPACT:

 

This multi-year project is included in the FY 16/17 Major Maintenance Program budget.  A budget of $575,000 has been allocated in the FY 17/18 Major Maintenance Program to complete construction.

 

Approval of this agenda will authorize the expenditure of $571,321 from the Major Maintenance Capital funding appropriation.

Award of this construction contract will implement the Major Maintenance Program, approved by the Board to be in alignment with the District’s vision, mission and strategic goals.

This agenda item supports the following Strategic Goal(s).

                     A Port that is a safe place to visit, work and play.

DISCUSSION:

 

Broadway Pier is situated at the west end of Broadway, between B Street Pier and Navy Pier. In 2015, the Port commissioned a structural inspection of the pier as part of a structural condition assessment of all cruise ship terminal facilities.  This inspection determined current conditions and recommendations for future repair and maintenance.  The current project was initiated based on results of this inspection.

 

The work includes repairs to piles/concrete encasements, pile cap areas, structural beam areas, and deck soffit locations of the pier.  The repairs will be conducted below the pier deck and above water.  The work will be coordinated with cruise ship terminal operation and marketing events to avoid any disruptions to scheduled activities, and will also comply with the requirements of the Army Corps of Engineers regional general permit.

 

The construction bid documents, including plans and specifications for Contract No. 2016-25 were advertised on April 12, 2017.  There were four (4) bids received on the bid opening date, May 16, 2017.  The four bid amounts ranged from $572,321 to $1,280,890, as shown in the table below:

 

 

 

The lowest responsive and responsible bid was received from Abhe & Svoboda, Inc. in the total bid amount of $571,321.  The engineers’ construction cost estimate was $513,920.

 

Review of the bid tabulation (Attachment A) shows that the high bidder had the highest costs on the non-structural bid items of General Construction, Longshoreman Insurance, and Construction Best Management Practices (BMP) Plan. The low bidder is within 12% of the engineers’ estimate and the price is considered reasonable.

 

Construction is expected to commence in July, 2017 and will be completed by November, 2017.

 

Staff recommends that the Board approve the plans and specifications and award Contract No. 2016-25 to Abhe & Svoboda, Inc. in the amount of $571,321 for the construction of the Structural Repairs to Broadway Pier project.

 

General Counsel’s Comments:

 

The Office of the General Counsel has reviewed the bid and contract documents and approves as to form and legality. 

 

Environmental Review:

 

The proposed Board actions to approve plans and specifications, and award a contract for structural repairs to Broadway Pier were previously analyzed under the NEVP Final Master Environmental Impact Report (NEVP FMEIR) that was adopted by the Board in 2000 (SCH #99031037, UPD #83356-EIR-351, Board of Port Commissioners Resolution No. 2000-82). The proposed project is consistent with the project described in the 2000 NEVP FMEIR as it proposes repairs to existing structural components of the Broadway Pier that were analyzed in the 2000 NEVP FMEIR.  Mitigation measures are included in the NEVP FMEIR to reduce the potentially significant impacts to below a level of significance. All mitigation measures will be implemented for the proposed project and enforced through the Coastal Development Permit (CDP). Therefore, the proposed Board action is consistent with the project analyzed in the 2000 NEVP FMEIR. The proposed Board action is not a separate “project” for CEQA purposes but is simply an additional governmental approval required to implement a previously approved project. (CEQA Guidelines § 15378(c); Van de Kamps Coalition v. Board of Trustees of Los Angeles Comm. College Dist. (2012) 206 Cal.App.4th 1036.) Accordingly, the District has determined that Board’s action is merely a step in furtherance of the original project for which environmental review was performed and no further environmental review is required.

 

In addition, the proposed Board action complies with Section 87 of the Port Act, which allows for the construction, reconstruction, repair, maintenance, and operation of public buildings public assembly and meeting places, convention centers, parks, playgrounds, bathhouses and bathing facilities, recreation and fishing piers, public recreation facilities, including, but not limited to, public golf courses, and for all works, buildings, facilities, utilities, structures, and appliances incidental, necessary, or convenient for the promotion and accommodation of any of those uses. The Port Act was enacted by the California Legislature and is consistent with the Public Trust Doctrine. Consequently, the proposed Board action is consistent with the Public Trust Doctrine.

 

Finally, on June 20, 2007, the Board authorized the issuance of a non-appealable CDP (CDP-2007-03) for the Broadway Pier Cruise Ship Terminal and Infrastructure Improvements Program (Resolution No. 2007-126). Compliance with all mitigation measures set forth in the in the NEVP FMEIR was a special condition of the CDP. Approving plans and specifications, and awarding a contract for structural repairs to Broadway Pier would allow for furtherance of the project authorized under CDP-2007-03. No further approvals are required pursuant to the California Coastal Act or District’s CDP Regulations.
