EXECUTIVE SUMMARY:

 

The San Diego Unified Port District (District) utilizes LinkedIn software services to promote the District’s brand and assist in recruiting and advertising position vacancies to secure interested, qualified and valued applicants. This agenda item requests that the Board of Port Commissioners (Board) authorize a single source agreement with LinkedIn in accordance with Board Policy 110 II(H & U).

 

RECOMMENDATION:

 

Recommendation

Adopt a Resolution authorizing an agreement with LinkedIn from June 12, 2018 until June 11, 2021, for social media recruiting services for an amount not to exceed $141,000 and a 5-year total cost of ownership of $235,000.  All funds required for future fiscal years will be budgeted in the appropriate fiscal year, subject to board approval upon adoption of each fiscal year’s budget.

FISCAL IMPACT:

 

Funds for the first year of this expenditure of $46,953 are included in the approved FY 2018 budget within the Information Technology Department Equipment & Systems account.  Staff estimates annual cash requirement of approximately $46,953 resulting in a 5-year total cash requirement of $244,156.

 

Funds required for future fiscal year(s) will be budgeted for in the appropriate year subject to Board approval upon adoption of each fiscal year’s budget.

Securing a multi-year agreement with LinkedIn provides the District the capability to reach out to individuals who fit to meet our constructive ideal culture that we may not have had access to previously.  Our goal is to hire and retain individuals that supports our goals to serve the public and who are innovative and motivated.

DISCUSSION:

 

LinkedIn is a business and employment-oriented service that operates via websites and mobile apps. It is mainly used for professional networking, including employers posting jobs and job seekers posting their resumes.  LinkedIn is the only domestic company/organization that provides the LinkedIn services offered via LinkedIn’s website www.linkedin.com <http://www.linkedin.com>

 

The District has had a relationship with LinkedIn since 2015.  In addition to the District’s homepage, which is used for press releases, District-sponsored activities and other general information, Human Resources staff utilizes LinkedIn as a source for recruiting potential candidates. By using the advanced search tools provided as part of the service, recruiters can find members matching the desired skills.  Specifically, the services provided to recruiters are:

 

                     Recruiter Seat (1) - This product provides the ability to search, source, and message over 500 million members on the network;

                     Job Slots (11) - Allows us to direct advertise the District’s current openings to candidates with matching skills sets;

                     Work With Us - Viewing people’s profiles is the number one activity on LinkedIn; this feature allows us to turn every single employee into a brand ambassador by using the space next to each profile to advertise jobs or careers at the District;

                     Career Page - The Career Page showcases the District’s culture by highlighting talent brand to the world. This feature drives advertisement to increase engagement.  People who view our career page are 2 times more likely to respond to inmails (LinkedIn’s version of email) and 3 times as likely to apply to jobs.

                     Job Wrapping - Advertising automatically pulls from our applicant tracking system (NeoGov) to populate jobs on LinkedIn.

 

The LinkedIn services above are proprietary to LinkedIn and are protected by the US patents and copyright registrations. We have successfully been able to reach qualified applicants in many different parts of the country and have enjoyed a wider advertising-presence through our relationship with LinkedIn.  The current agreement with LinkedIn ends in mid-June.

 

In order to enter into an agreement with LinkedIn as a single source agreement without competition in excess of $175,000 requires Board authorization per Board Policy 110. The total cost including a five year TCO is $244,156.

 

District staff recommends that the Board adopt this resolution and award an agreement with LinkedIn.

 

General Counsel’s Comments:

 

The Office of the General Counsel has reviewed the issues set forth in this agenda and found no legal concerns as presented.  Section 81 of the San Diego Unified Port Act authorizes the District to expend funds to be used for the necessary expenses of conducting the District.  Board of Port Commissioners - BPC Policy 110, allows the Executive Director to enter into single or sole source agreements without the need for competition, with agreements in excess of $175,000 required to be authorized by the Board of Port Commissioners.

 

Environmental Review:

 

The Board direction or action, including without limitation, a resolution authorizing an agreement for social media recruiting services, does not constitute an “approval” or a “project” under the definitions set forth in California Environmental Quality Act (CEQA) Guidelines Sections 15352 and 15378 because no direct or indirect changes to the physical environment would occur. CEQA requires that the District adequately assess the environmental impacts of projects and reasonably foreseeable activities that may result from projects prior to the approval of the same.  Any project developed as a result of Board’s action or direction that requires the District or the Board’s discretionary approval resulting in a physical change to the environment will be analyzed in accordance with CEQA prior to such approval.  CEQA review may result in the District, in its sole and absolute discretion, requiring implementation of mitigation measures, adopting an alternative, including without limitation, a “no project alternative” or adopting a Statement of Overriding Consideration, if required. The current Board direction in no way limits the exercise of this discretion. Therefore, no further CEQA review is required.

 

In addition, the proposed Board action complies with Section 81 of the Port Act which allows for the use of funds for necessary expenses of conducting the District. The Port Act was enacted by the California Legislature and is consistent with the Public Trust Doctrine. Consequently, the proposed Board action is consistent with the Public Trust Doctrine.

 

The proposed Board direction or action does not allow for “development,” as defined in Section 30106 of the California Coastal Act, or “new development,” pursuant to Section 1.a. of the District’s Coastal Development Permit (CDP) Regulations because they will not result in, without limitation, a physical change, change in use or increase the intensity of uses. Therefore, issuance of a Coastal Development Permit or exclusion is not required. However, development within the District requires processing under the District’s CDP Regulations. Future development, as defined in Section 30106 of the Coastal Act, will remain subject to its own independent review pursuant to the District’s certified CDP Regulations, PMP, and Chapters 3 and 8 of the Coastal Act.  The Board’s direction or action in no way limits the exercise of the District’s discretion under the District’s CDP Regulations. Therefore, issuance of a CDP or exclusion is not required at this time.
