RESOLUTION ESTABLISHING THE BOARD OF PORT COMMISSIONERS’ REGULAR MEETING DATES FOR CALENDAR YEAR 2016

EXECUTIVE SUMMARY:
Section 2 of BPC Policy No. 21 sets forth the requirement that the dates, time and location of the regular meetings of the Board of Port Commissioners of the San Diego Unified Port District shall be set annually by Resolution.
RECOMMENDATION:
Recommendation
Adopt a Resolution establishing the regular meeting dates of the Board of Port Commissioners for calendar year 2016 (Attachment A).

DISCUSSION:
Establishment of the regular meeting dates for the year will provide the Board of Port Commissioners and other interested parties with advanced notice of upcoming meetings.
Please note that on each regular meeting date, there are two (2) meetings of the Board of Port Commissioners: A closed session and a regular meeting. Each meeting is noticed separately.
Any additional meetings that may be necessary during the year will be scheduled and posted as special meetings.
General Counsel’s Comments:
The General Counsel’s Office has reviewed the issues set forth in this agenda sheet and found no legal concerns as presented. California Harbors and Navigation Code (Port Act), § 18 requires that the Board hold at least one regular meeting each month, and may hold any special meetings it deems necessary, and may meet in closed session as set forth in California Government Code (Brown Act) § 54950 et seq
Environmental Review:
The proposed Board action does not constitute a “project” under the definition set forth in California Environmental Quality Act (CEQA) Guidelines Section 15378 because it will not have a potential to result in a direct or indirect physical change in the environment and is therefore not subject to CEQA. No further action under CEQA is required.
The proposed Board action does not allow for “development,” as defined in Section 30106 of the California Coastal Act, or “new development,” pursuant to Section 1.a. of the District’s Coastal Development Permit Regulations. Therefore, issuance of a Coastal Development Permit or exclusion is not required.
