EXECUTIVE SUMMARY:

 

Since 1960, American Public Works Association (APWA) has sponsored National Public Works Week. Across the nation, National Public Works Week (NPWW) calls attention to the importance of public works in community life. The week seeks to raise public awareness of the often-unsung heroes of our society: The professionals who serve the public good every day with quiet dedication. The San Diego Unified Port District wishes to show its support for APWA.

 

RECOMMENDATION:

 

Recommendation

Adopt a Resolution proclaiming May 20-26, 2018 National Public Works Week at the San Diego Unified Port District.

DISCUSSION:

 

National Public Works Week (NPWW) is a celebration of the tens of thousands of men and women in North America who provide and maintain the infrastructure and services collectively known as public works. Since 1960, American Public Works Association (APWA) has sponsored NPWW. Across the nation, NPWW calls attention to the importance of public works in community life. The week seeks to raise public awareness of the often-unsung heroes of our society: The professionals who serve the public good every day with quiet dedication. The San Diego Unified Port District wishes to show its support for the APWA. APWA has selected "Power of Public Works" as its theme for 2018's NPWW, which will be celebrated May 20-26, 2018. Public works projects and services improve quality of life and social benefits, and they are one of the basic elements of our civilized society and our nation's economic growth.

 

General Counsel’s Comments:

 

The Office of the General Counsel has reviewed the issues presented in this agenda sheet and approves as to form and legality.

 

Environmental Review:

 

The proposed Board direction or action, including without limitation, a resolution proclaiming support of NPWW does not constitute a “project” under the definition set forth in California Environmental Quality Act (CEQA) Guidelines Section 15378 because it will not have a potential to result in a direct or indirect physical change in the environment and is, therefore, not subject to CEQA. No further action under CEQA is required.

 

In addition, the proposed Board action allows for the District to implement its obligations under Section 35 of the Port Act, which allows the Board to do all acts necessary and convenient for the exercise of its powers. The Port Act was enacted by the California Legislature and is consistent with the Public Trust Doctrine. Consequently, the proposed Board action is consistent with the Public Trust Doctrine.

 

The proposed Board direction or action does not allow for “development,” as defined in Section 30106 of the California Coastal Act, or “new development,” pursuant to Section 1.a. of the District’s Coastal Development Permit Regulations. Therefore, issuance of a Coastal Development Permit or exclusion is not required.
