RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND AWARDING CONTRACT NO. 2017-07 TO SDSTATURE IN THE AMOUNT OF $279,000.00 FOR THE STORAGE MODIFICATIONS AT HARBOR POLICE HEADQUARTERS ANNEX PROJECT, AS AUTHORIZED BY THE BOARD IN THE FISCAL YEAR 2020 EQUIPMENT OUTLAY AND OTHER CAPITAL PROJECTS APPROPRIATION

EXECUTIVE SUMMARY:
The Storage Modifications at Harbor Police Headquarters Annex Project (Project) provides for the demolition of the existing storage deck system inside the annex shed and construction of a new steel mezzanine, fenced enclosures, and placement of drywall for storage needs. Harbor Police Headquarters (HPHQ) is located at 3380 North Harbor Drive, San Diego, CA 92101. The Project was included in the FY 19/20 Equipment Outlay and Other Capital Projects Program at a budgeted amount of $365,000.
On October 24th, 2019 the District received seven (7) bids to execute the Project ranging from $279,000.00 to $359,900.00. The lowest responsive and responsible bid was submitted by SDSTATURE, located in San Diego, in the amount of $279,000.00. The plans and specifications before the Board of Port Commissioners (Board) define the contract work. Staff recommends that the San Diego Unified Port District (District) Board approve the plans and specifications and authorize the award of an Equipment Outlay and Other Capital Projects construction contract to SDSTATURE in the amount of $279,000.00 for the Storage Modifications at Harbor Police Headquarters Annex Project.

Adopt a resolution approving plans and specifications and awarding Contract No. 2017-07 to SDSTATURE in the amount of $279,000.00 for the construction of the Storage Modifications at Harbor Police Headquarters Annex Project, as authorized by the Board in the Fiscal Year 2020 Equipment Outlay and Other Capital Projects appropriation.

FISCAL IMPACT:
This project is included in the FY 19/20 Equipment Outlay and Other Capital Projects Program budget. A budget amount of $365,000.00 has been allocated in the FY 19/20 Equipment Outlay and Other Capital Projects Program budget for the project. Approval of this agenda will authorize the expenditure of $279,000.00 from the Equipment Outlay and Other Capital Projects funding appropriation.

Award of this construction contract will implement the Equipment Outlay and Other Capital Projects Program, approved by the Board to be in alignment with the District’s vision, mission and strategic goals.

DISCUSSION:
The Project is within HPHQ located at 3380 North Harbor Drive, San Diego, CA 92101. The Project includes demolition of the existing storage deck system inside the annex shed and construction of a new steel mezzanine, fenced enclosures, and placement of drywall for storage needs.
The Contract Documents including plans No. HI-2018-02 and specifications No. 2017-07 were issued for advertisement on September 26th, 2019. On October 24th, 2019, seven (7) bids were received ranging from $279,000.00 to $359,900.00. The bid amounts are as shown in the table below.

Based on a review of the bids, the lowest responsive and responsible bid was determined to be submitted by SDSTATURE at $279,000.00. The engineer’s construction cost estimate was $300,000.00. Upon Board authorization, construction is expected to commence in January 2020 and be completed by May 2020.
Staff recommends that the Board approve the plans and specifications and award Contract No. 2017-07 to SDSTATURE in the amount of $279,000.00 for the construction of the Storage Modifications at Harbor Police Headquarters Annex Project.
General Counsel’s Comments:
The Office of the General Counsel has reviewed the agenda sheet and attachment, as presented to it, and approves them as to form and legality.
Environmental Review:
The proposed Board action, including without limitation, a resolution approving plans and specifications and awarding a contract for the storage modifications at Harbor Police Headquarters Annex project, is Categorically Exempt pursuant to California Environmental Quality Act (CEQA) Guidelines Sections 15301 (Existing Facilities) and/or 15303 (New Construction or Conversion of Small Structures) and Sections 3.a. (3) (Existing Facilities) and/or 3.c. (2) (New Construction or Conversion of Small Structures) of the District’s Guidelines for Compliance with CEQA because the project in question would consist of the modification of existing accessory storage facilities that would involve no expansion of use beyond that previously existing. The District has determined none of the six exceptions to the use of a categorical exemption apply to this project (CEQA Guidelines Section 15300.2).
The proposed Board action complies with sections 21, 35, and 87 of the Port Act, which allow the Board to pass resolutions and to do all acts necessary and convenient for the exercise of its powers, and for the use of tidelands for the construction, reconstruction, repair, maintenance, and operation of public buildings, public assembly and meeting places, convention centers, parks, playgrounds, bathhouses and bathing facilities, recreation and fishing piers, public recreation facilities, including, but not limited to, public golf courses, and for all works, buildings, facilities, utilities, structures, and appliances incidental, necessary, or convenient for the promotion and accommodation of any of those uses. The Port Act was enacted by the California Legislature and is consistent with the Public Trust Doctrine. Consequently, the proposed Board action is consistent with the Public Trust Doctrine.
The proposed Board action is considered “excluded development” pursuant to Section 8.a (Existing Facilities) and/or 8.c (3) of the District’s Coastal Development Permit Regulations because the project in question would consist of the modification of existing accessory storage facilities that would involve no expansion of use beyond that previously existing and would not change the existing use of the property. No further action under the Coastal Act is required.
