EXECUTIVE SUMMARY:

 

The San Diego Unified Port District (District) Harbor Police Department (HPD) implemented CommandBridge, which is a software and video situational awareness solution that provides a real-time view of various sensor systems ranging from vessel locations to the District’s secure video system. CommandBridge was created and configured by The Mariner Group, a subsidiary of Ares Security Corporation, which provides exclusive support and maintenance for the solution’s software, functionality and data integration.

 

CommandBridge was implemented with support from a United States Port Security Grant, and the grant-funded project work was completed in Fiscal Year 2017.  The solution is under maintenance and support extending from the original implementation agreement that is available through June 30, 2018.  Thereafter, maintenance and support for the CommandBridge software and overall solution is needed to assure ongoing access, availability and performance as its role continues to expand at the Joint Harbor Operations Center, the HPD and the San Diego region.  The cost for CommandBridge maintenance and support is $70,192 per year for the next three fiscal years, resulting in the recommended agreement total of $210,576.  This three-year maintenance and support agreement is a component of a $646,665 five-year Total Cost of Ownership.

 

The Mariner Group is the sole provider of CommandBridge software maintenance and solution support.  Therefore, Staff recommends that the Board waive Board of Port Commissioners (BPC) Policy No. 110 II (E) and authorize a sole source agreement with Ares Security Corporation dba The Mariner Group for CommandBridge maintenance and support.

Recommendation

Adopt a Resolution Waiving Board of Port Commissioners Policy No. 110 II (E) and Authorize a Sole Source Agreement with ARES Security Corporation dba The Mariner Group from July 1, 2018 through June 30, 2021, for CommandBridge Maintenance and Support for an amount not to exceed $210,576 and a five-year Total Cost of Ownership of $646,665.  Funds required for future services will be requested per policy, and for maintenance and support in future fiscal years will be budgeted for in the appropriate fiscal year and cost account subject to BPC approval upon adoption of each fiscal year’s budget.

FISCAL IMPACT:

 

Funds for the first year of the expenditure for maintenance and support are budgeted in the FY18/19 in the HPD Non-Personnel Expense budget.  Funds required for future services will be requested per policy, and for maintenance and support in future fiscal years will be budgeted for in the appropriate fiscal year and cost account subject to Board approval upon adoption of each fiscal year’s budget.

 

CommandBridge, as a technology solution, is subject to a five year Total Cost of Ownership (TCO) forecast, per BPC Policy No. 110, Section III (F).  The table below forecasts both Services and Software Maintenance for CommandBridge. Services are estimated to include costs for solution enhancements, integration of additional sensor systems, and work to engage and improve marine domain awareness and public safety operational capabilities. Software Maintenance includes the maintenance and support recommended in this report at a fixed rate for three years for the current scope of the solution, and an estimate of future maintenance.  All projected and estimated costs, as depicted, are subject to Board approval upon adoption of each fiscal year’s budget.

 

 

Opportunities to expand and evolve CommandBridge through interagency collaboration, evolution to a regional platform, and the availability for investment through United States Port Security Grant Program and other outside funding sources will affect the level of District participation reflected in this TCO.

 

DISCUSSION:

 

The HPD implemented CommandBridge, a situational awareness solution that provides a real-time view of various sensor systems ranging from vessel locations to the District’s secure video system. CommandBridge was implemented with a United States Port Security Grant award, with project work completed on June 30, 2017. The CommandBridge solution enhances situational awareness for public safety with integrated sensor systems, such as vessel locations, video of tidelands and decision-support tools on a map-based platform that runs on the District’s network. 

 

CommandBridge is used to monitor and manage field operations within HPD and the Joint Harbor Operations Center.  It has received local, regional and national attention as a working situational awareness solution and a living example of how technology, well and thoughtfully executed, can inform decisions and improve the coordination of public safety and security operations.

 

CommandBridge is comprised of hardware, software and data integration schemas proprietary to The Mariner Group; no third party is authorized to develop modifications, bug fixes or new releases for CommandBridge.  As a technology solution, CommandBridge requires maintenance and support to assure it performs, data integration is present, and the interface is accessible by users from its servers that run within the Port’s network, and from the data integrated from various secure sources.  The Mariner Group is the exclusive provider of CommandBridge, and installed and configured this system for the Port.  Maintenance and support services are provided by The Mariner Group during the CommandBridge implementation warranty period that ends on June 30, 2018.

 

The Mariner Group stands as the sole provider of CommandBridge software maintenance and solution support.  Due to this, staff recommends that the BPC waive the bidding requirements of BPC Policy No. 110 II (E) and authorize a sole-source agreement with Ares Security Corporation dba The Mariner Group for CommandBridge maintenance and support.

 

The cost for CommandBridge maintenance and support is $70,192 per year for the next three fiscal years, resulting in the recommended agreement total of $210,576.  This maintenance and support agreement is a component of a $646,665 five-year Total Cost of Ownership estimate.

 

The Total Cost of Ownership estimate is inclusive of maintenance, support and services.  Maintenance and support costs are estimated at $361,665 for five years.   Services costing $285,000 as projected for enhancements, sensor integration and other work necessary to enhance interoperability and a positive effect on marine domain awareness are foreseeable and estimated as follows:

 

                     FY18/19:  $60,000 for enhanced mapping and integration of facility data; $30,000 for video interoperability with other organizations; $15,000 for configuration/enhancements, $15,000 for training and event support.

                     FY19/20:  $15,000 for in-bay radar and similar source integration; $30,000 for new dispatch system integration; $15,000 for training and event support.

                     FY20/21:  $30,000 for sensor system (TBD) integration; $15,000 for training, event support, and expanded functionality offset.

                     FY21/22: $15,000 for system updates and refresh; $15,000 for training, event support and expanded functionality offset.

                     FY22/23: $15,000 for configuration updates and enhancements; $15,000 for training, event support, and expanded functionality offset.

General Counsel’s Comments:

 

The Office of the General Counsel has reviewed the agreement with Ares Security Corporation, dba The Mariner Group and approves as to form and legality.

 

Environmental Review:

 

The proposed Board direction or action, including without limitation, authorizing an agreement for technology maintenance and support, does not constitute a “project” under the definition set forth in California Environmental Quality Act (CEQA) Guidelines Section 15378 because no direct or indirect changes to the physical environment would occur. CEQA requires that the District adequately assess the environmental impacts of projects and reasonably foreseeable activities that may result from projects prior to the approval of the same.  Any project developed as a result of Board’s action or direction that requires the District or the Board’s discretionary approval resulting in a physical change to the environment will be analyzed in accordance with CEQA prior to such approval.  CEQA review may result in the District, in its sole and absolute discretion, requiring implementation of mitigation measures, adopting an alternative, including without limitation, a “no project alternative” or adopting a Statement of Overriding Consideration, if required. The current Board direction in no way limits the exercise of this discretion. Therefore, no further CEQA review is required.

 

In addition, the proposed Board action complies with Sections 21, 30, and 81 of the Port Act, which allow for the Board to pass ordinances and resolutions, manage the business of the District by providing technology maintenance and support, and use District funds for expenses of conducting the District. The Port Act was enacted by the California Legislature and is consistent with the Public Trust Doctrine. Consequently, the proposed Board action is consistent with the Public Trust Doctrine.

 

The proposed Board direction or action does not allow for “development,” as defined in Section 30106 of the California Coastal Act, or “new development,” pursuant to Section 1.a. of the District’s Coastal Development Permit (CDP) Regulations because they will not result in, without limitation, a physical change, change in use or increase the intensity of uses. Therefore, issuance of a Coastal Development Permit or exclusion is not required. However, development within the District requires processing under the District’s CDP Regulations. Future development, as defined in Section 30106 of the Coastal Act, will remain subject to its own independent review pursuant to the District’s certified CDP Regulations, PMP, and Chapters 3 and 8 of the Coastal Act.  The Board’s direction or action in no way limits the exercise of the District’s discretion under the District’s CDP Regulations. Therefore, issuance of a CDP or exclusion is not required at this time.
