RESOLUTION ESTABLISHING THE BOARD OF PORT COMMISSIONERS’ REGULAR MEETING DATES FOR CALENDAR YEAR 2024

EXECUTIVE SUMMARY:
Section 2 of Board of Port Commissioners (BPC) Policy No. 21 requires that the dates, time and location of the regular meetings of the Board of Port Commissioners of the San Diego Unified Port District be set annually by Resolution.

Adopt a Resolution establishing the regular meeting dates of the Board of Port Commissioners for calendar year 2024 (Attachment A).

DISCUSSION:
Establishing regular meeting dates for the year will provide the Board of Port Commissioners, the public and other interested parties with advanced notice of upcoming meetings.
On each regular meeting date, there are two (2) meetings of the Board of Port Commissioners - a closed session meeting and a regular meeting. Each meeting is noticed separately.
Any additional meetings that may be necessary during the year will be scheduled and posted as special meetings.
General Counsel’s Comments:
The General Counsel’s Office has reviewed this agenda sheet, as presented, and approves it as to form and legality. California Harbors and Navigation Code, Appendix I (Port Act), § 18 requires that the Board hold at least one regular meeting each month, and authorizes the Board to hold any special meetings it deems necessary. Additionally, the Board may meet in closed session as set forth in the Ralph M. Brown Act (Government Code § 54950 et seq.).
Environmental Review:
The proposed Board action, including without limitation, a resolution establishing the Board of Port Commissioners’ regular meeting dates for calendar year 2024, does not constitute a project under the definition set forth in California Environmental Quality Act (CEQA) Guidelines Section 15378 because there is not a potential to result in a direct or indirect physical change in the environment. Therefore, the proposed Board action is not subject to CEQA and no further action under CEQA is required.
The proposed Board action complies with Sections 21 and 35 of the Port Act, which allow the Board to pass resolutions; and to do all acts necessary and convenient for the exercise of its powers. The Port Act was enacted by the California Legislature and is consistent with the Public Trust Doctrine. Consequently, the proposed Board action is consistent with the Public Trust Doctrine.
The proposed Board action does not allow for development, as defined in Section 30106 of the California Coastal Act, or new development, pursuant to Section 1.a. of the District’s Coastal Development Permit Regulations. Therefore, issuance of a Coastal Development Permit or an exclusion finding is not required.
