EXECUTIVE SUMMARY:

 

The District’s Harbor Police Department currently utilizes SAFE (Secure All-around Flotation Equipped) boats to patrol San Diego Bay waters. SAFE boats Marine 6 (equipment number 7762), Marine 7 (equipment number 7763) and Marine 8 (equipment number 9066) are currently equipped with 300 horsepower outboard engines. These engines have experienced high usage and are nearing the end of their useful service lives. Replacement of these engines is crucial in order to maintain police response readiness while reducing fuel consumption by eight percent or greater.

 

Funds for repowering the three (3) SAFE boats and purchasing one spare outboard engine are being provided through the Department of Homeland Security Fiscal Year 2018 Port Security Grant Program (PSGP), with the District providing a cash contribution of $90,441.57. All items proposed are included in the FY 2020 Equipment Outlay and Other Capital Projects budget.

 

Pursuant to BPC Policy 110, Section II C, Request for Bid (RFB) No. RFB 19-34DB-1 was solicited on October 15, 2019 and closed on October 29, 2019. A total of 247 service providers were notified. The District received six (6) responsive bids. Adept Process Services, Inc. submitted the lowest responsive and responsible bid. Adept Process Services, Inc. is a National City based company that provides specialty marine and waterfront services for commercial and government customers nationwide.

 

Staff recommends the Board of Port Commissioners (Board) select and authorize an agreement with Adept Process Services, Inc. to provide services to repower three (3) Harbor Police Department SAFE boats and supply one spare engine in an amount not to exceed $240,000.

Adopt a resolution selecting and authorizing an agreement with Adept Process Services, Inc. for repowering three Harbor Police Department SAFE boats and purchasing one spare engine in an amount not to exceed $240,000.

FISCAL IMPACT:

 

Grant funds will provide $149,250 toward the cost of repowering the SAFE boats through the Department of Homeland Security Fiscal Year 2018 Port Security Grant Program (PSGP), under grant number EMW2018PU00247. A “cash match” contribution of $90,441.57 will be provided by the District. All funding for the agreement is budgeted in the FY 2020 Equipment Outlay and Other Capital Projects budget, under the General Services Department.

DISCUSSION:

 

The Harbor Police Department utilizes SAFE boats to patrol San Diego Bay.  The SAFE boats are equipped with 300 horsepower outboard engines that have experienced high usage and are nearing the end of their useful service lives. Replacement of these engines is crucial in order to maintain police response readiness. If this request is approved, the following vessels will be repowered:

o                     Marine 6 (#7762) - 31’ SAFE Boat walk around cabin, twin 300 HP outboard engines

o                     Marine 7 (#7763) - 31’ SAFE Boat full cabin, twin 300 HP outboard engines

o                     Marine 8 (#9066) - 36’ SAFE Boat full cabin, three 300 HP outboard engines

 

Replacement of engines on these SAFE boats is recommended in order to improve safety and reliability of service needed for critical Harbor Police operations. Life expectancy of the outboard engines currently installed on the SAFE boats is between 2,000 to 3,000 hours; the engines on all three (3) SAFE boats are at or exceeding seventy-percent of recommended service hours, thus replacement is desired. The new outboards have a higher star environmental rating and will provide more user-friendly features that will enable crews to better optimize their performance. Additionally, a reduction in fuel usage of eight-percent or greater is projected following engine replacement. The spare engine is needed to reduce the downtime associated with the repair and/or replacement of SAFE boat engines.

The three (3) lowest responsive and responsible bids accepted are summarized below from lowest to highest.

 

 

 

Adept Process Services, Inc. is a National City based company that provides specialty marine and waterfront services for commercial and government customers nationwide. Adept Process Services, Inc. focuses on providing service reliability for critical daily operations to its customers from its 31,000 square foot repair facility in National City. The company reports that it is NAVSEA 009-04 and ISO compliant, and provides services on hull, mechanical, electrical, hydraulics, and electronics elements of vessel maintenance, with a specialty in outboard engines. The company also performs custom marine welding and fabrication and provides assembly, maintenance and repair of waterfront equipment.

 

Staff recommends the Board select and authorize an agreement with Adept Process Services, Inc. to replace engines on three (3) Harbor Police Department SAFE boats and purchase one spare engine, effective December 16, 2019 to June 30, 2020, in an amount not to exceed $240,000. 

 

General Counsel’s Comments:

 

The General Counsel’s Office has reviewed the agenda sheet and attachments, as presented to it, and approves them as to form and legality.

 

Environmental Review:

 

The proposed Board action, including without limitation, a resolution selecting and authorizing an agreement for repowering three SAFE boats and purchasing a spare engine is Categorically Exempt pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15301 (Existing Facilities) and Section 3.a. of the District’s Guidelines for Compliance with CEQA because the project in question would involve no expansion of use beyond that previously existing. The District has determined none of the six exceptions to the use of a categorical exemption apply to this project (CEQA Guidelines Section 15300.2).  A CEQA Exemption was previously issued for this project on November 8, 2018 (2018-200). The proposed project is consistent with the project analyzed in the Categorical Determination. The proposed Board action is not a separate “project” for CEQA purposes but is a subsequent discretionary approval related to a previously approved project. (CEQA Guidelines § 15378(c); Van de Kamps Coalition v. Board of Trustees of Los Angeles Comm. College Dist. (2012) 206 Cal.App.4th 1036.) Accordingly, the proposed Board action is merely a step-in furtherance of the original project for which environmental review was performed, and no further environmental review is required.

 

In addition, the proposed Board direction or action complies with sections 21, 35, and 81 of the Port Act, which allow for the Board to pass resolutions, to do all acts necessary and convenient for the exercise of its powers, and to use District funds for expenses of conducting the District. The Port Act was enacted by the California Legislature and is consistent with the Public Trust Doctrine. Consequently, the proposed Board action is consistent with the Public Trust Doctrine.

 

Finally, the proposed Board direction or action is considered “excluded development” pursuant to Section 8.a (Existing Facilities) of the District’s Coastal Development Permit Regulations because the project in question would involve a negligible expansion of use beyond that previously existing, would have no permanent effects on the environment, and would not involve the removal of mature, scenic trees. A “Coastal Act Categorical Determination of Exclusion” was previously issued for this project on November 8, 2018 (2018-200); therefore, issuance of a Coastal Development Permit or subsequent Exclusion is not required for the proposed Board action.
